Regulators Crack Down On New Mexico Shop For Gifting Cannabis

In New #Mexico, a #LasCruces retailer comes under fire for the practice of “gifting” #cannabis ahead of the state’s #recreational market launch. Speak Easy, which the owners describe as a novelty and #gift shop, received a cease and desist order from the state’s Cannabis Control Division. While the agency accuses Speak Easy of intentionally trafficking marijuana products in violation of #New Mexico’s Cannabis Regulation Act, the store’s attorney says the law is unsettled, and does not specifically address the activity. Since the state legalized #adult-use possession on #June 29th, Speak Easy has been offering customers 21 and older samples of cannabis ranging from 1.5 to 7 #grams with the purchase of stickers costing between 15 and 90 #dollars. The store has reportedly raked in tens of thousands of dollars in sales as a result of the arrangement. Attempts to take advantage of the arguably legal loophole of gifting cannabis have been seen throughout the country, with state responses varying from tolerance in places like #Michigan and #Maine to enforcement against such operations in #Vermont and New #Jersey. As Speak Easy appears to be undeterred by the government notice and continues to #advertise #marijuana samples on their #Facebook page, it’s unclear if their activity will impact their future eligibility for a cannabis retail license when they are expected to be issued in #April of next year.
