LAWSUIT ALERT!!!! LIKE AND SHARE PLEASE!!!
In our continued effort to protect existing Oklahoma medical marijuana businesses and patients, Christina Vaughn and I are filing a lawsuit today against the Oklahoma Medical Marijuana Authority via the Oklahoma Department of Health as it relates to two issues: 1. The 2 year residency requirement, and 2. the 1,000 foot rule related to dispensaries and schools/preschools. As you all know by now, the 2 year residency requirement is causing people that uprooted their family and moved them to Oklahoma the ability to renew their license. When the voters approved 788, it required only that people be residents. In 2019, the Legislature changed that to 2 years meaning these people that risked it all and already have a license now face losing the license through absolutely no fault of their own. NOTE: THE LAWSUIT MAKES CLEAR IT HAS NOTHING TO DO WITH THE 75% IN STATE OWNERSHIP REQUIREMENT AS WE WANT THAT PRESERVED.
As it relates to the 1,000 foot rule, the 2019 legislation changed the definition of school and added preschool. The legislation also meant OMMA had to define entrance to a school. This has left hundreds of businesses unable to renew their license because they were legal when licensed, but not they find that they are within 1,000 feet of the new definition of entrance or within 1,000 feet of a preschool which was not originally part of the requirement.
The lawsuit is aimed at resolving both of those issues in an amicable manner. I will be meeting with Representative Jon Echols, Representative Scott Fetgatter, and Attorney General Mike Hunter to discuss these issues and hopefully work out an agreed injunction. During this meeting, we will also discuss the continuation of the Injunction I previously obtained to protect patient information from release to OLETS.
As always, we continue striving to fight hard to protect the intent of 788. Also, we are again doing this WITHOUT COMPENSATION as none of the Plaintiffs are paying us for this work. Now, one day, that has to change, but until we have OK4U fully up and running with resources, we will continue to do our part.
