SLUSHIE (or slushy) MACHINES ARE OUT!!!
Love them or hate them, a question that’s been swirling around has been whether a dispensary can have a slush or machine with THC in the product. I’ve probably answered this question 15 times in the negative. They simply can’t meet the testing or packaging rules. The OMMA apparently got a lot of questions as well, and they have spoken. Slushy machines, at least the way I’ve seen them done, are not allowed under current law. There are easy solutions to this issue, so I hope those impacted figure it out and solve the issues.
Update: I think it’s a clever idea, and in no way am I advocating that they shouldn’t make a comeback. It’s just that to be compliant with the rules as they are, it needs to be done a slightly different way.
Now, to be picky. The OMMA post has a sentence that reads, “Dispensaries are not allowed to alter, package, or label products.” I get what they intended to mean (which to alter packaged products once they arrive packaged and labeled), but the lawyer in me needs to clarify that, as written, the OMMA is wrong on that one. To avoid getting asked this 100 times or more, Dispensaries ARE ALLOWED to take deli-style flower and alter, package and label it at the dispensary. Hope that avoids any confusion because I’m doubting people will follow the link OMMA provided to figure out what they actually meant by that statement.
